Public Hearings



 1. A Resolution to Adopt the 2021-2022 Through 2026-2027 Six-Year Plan for Secondary Roads (SSYP) and the 2021-2022 Fiscal Year Budget - Pursuant to Section 33.2-331 of the Code of Virginia, 2014, as amended, a joint public hearing will be held with the Board of Supervisors and a representative from the Virginia Department of Transportation (VDOT) to receive public comment on the proposed Secondary System Construction Program for Fiscal Year 2021-2022 through Fiscal Year 2026-2027.  2. A Resolution Authorizing the County Administrator to Execute a Right of Way Agreement to Northern Virginia Electric Cooperative for an Electric Utility Easement Across Property Owned by Fauquier County Identified as PIN# 7915-64-9304-000 Located on Aiken Drive in Scott Magisterial District - Fauquier County is the owner of property identified as PIN# 7915-64-9304-000 on Aiken Drive in Scott Magisterial District.  Northern Virginia Electric Cooperative requires an easement for electric power purposes to serve facilities on the County-owned property.  After the holding of a duly noticed public hearing, the attached resolution authorizes the County Administrator to execute an Easement and Right of Way Agreement with Northern Virginia Electric Cooperative for the requested easement.  3. A Public Hearing to Authorize Condemnation and Entry Upon and Taking of Easements Over Portions of 2 Parcels of Real Estate for the Catlett and Calverton Sewer System - Consider authorizing condemnation to acquire a permanent sewer easement and temporary construction easement for the Catlett and Calverton Sewer Project on two properties owned by the Heirs of Effie Kerns (PINs 7922-91-3258; 7922-91-4227) located in Catlett along Tenerife Road.  4. A Public Hearing to Amend Section 17-55 of the Fauquier County Code - Consider amendments to Section 17-55 to allow an owner of an existing structure constructed prior to April 8, 2021 on a parcel comprised of 4.9999 acres or fewer that is immediately adjacent to the Catlett Service District or Village of Calverton and that has a failed or failing on-site septic system to connect to the County sewer system provided there is capacity.  5. A Zoning Ordinance Text Amendment to Articles 3, 5 and 15 to Revise the Ordinance Provisions Related to the Importation, Storage or Disposal of Fill Material - This text amendment amends the standards and definitions in conjunction with the importation, storage, and disposal of nonagricultural fill, excavation material, waste and debris if the materials are not generated on the farm. The Attorney General opined that jurisdictions may require a legislative approval for fill operations where the materials are not generated on the farm. The Board of Supervisors initiated this text amendment on July 11, 2019. On March 18, 2021, the Planning Commission unanimously recommended approval following a public hearing on March 18, 2021.  6. A Zoning Ordinance Text Amendment to Section 5-001.4 Requiring Special Exception Approval by the Board of Supervisors for Special Permit Uses Allowed on Property Subject to an Open Space Easement - This proposed text amendment would adopt a Zoning Ordinance provision that would shift the authority for approving a Special Permit from the Board of Zoning Appeals to the Board of Supervisors for proposed uses requiring a Special Permit on property encumbered by an open space or conservation easement. The Board of Supervisors initiated this text amendment on December 10, 2020.  On March 18, 2021, the Planning Commission unanimously recommended approval of the text amendment.  7. A Resolution to Approve Sign Design Package SPAC-20-014295 - An Application to Amend a Previously Approved Sign Design Appendix to the Code of Development (SPAC-14-000811) for the Mintbrook Development (Various PINs, Lee District) - The Applicant is seeking to amend a previously approved Sign Design Package (SPAC-14-000811) for the Mintbrook Development. The proposed amendment includes relocating signs and adding new signs to increase visibility of the community's commercial area. The properties are located on Marsh Road and Lafayette Avenue. On March 18, 2021, the Planning Commission voted 4 to 0, with one Commissioner recusing himself, to approve the Sign Design Package and recommend approval of the Code of Development amendment.  8. A Resolution to Approve Special Exception SPEX-20-014021 - Fauquier County Lagoon - An Application to Amend a Previously Approved Category 18 Special Exception (SEAM08-CR-003) for a Biosolids Storage Facility and Renew a Category 23 Special Exception (SPEX08-CR-014) to Continue an Existing Use Located Within the Floodplain (PIN 7808-52-6185-000, Cedar Run District) - The Applicant is seeking to amend two Special Exceptions  last approved by the Board of Supervisors in July 2008 for a biosolids storage facility off Ritchie Road (Route 644) in southeastern Fauquier County. The property is located at 11738 Ag Industrial Road southeast of Bealeton. At its March 18, 2021 meeting, the Planning Commission voted 4 to 1 to recommend approval of the application. (Calvin L.
