Public Hearings

 1. A Public Hearing to Consider Amending Chapter 4, Article II (Dogs and Cats) of the Fauquier County Code to Authorize Lifetime Dog Licenses - Code of Virginia § 3.2-6530(B) was amended to authorize the Board of Supervisors to provide by ordinance for the sale of lifetime dog licenses for dogs over the age of four months. On September 13, 2018, the Board of Supervisors directed the County Administrator to schedule a public hearing to consider amendments to Chapter 4, Article II (Dogs and Cats) of the Fauquier County Code to provide for the sale of lifetime dog licenses. That Article currently provides for the sale of dog licenses annually or every three years on dogs over the age of four months. If the Board prefers to levy the dog license tax once for the lifetime of dogs over the age of four months, then the Ordinance must be amended. A charge of $10.00 per license for the lifetime of the dog is proposed. No changes to the provisions regarding kennel licenses are proposed. Prior to amending the Code, it is necessary to conduct a public hearing to consider the public's input on the amendments.  (Richard Gerhardt, Cedar Run District Supervisor, Sponsor; Mary Catherine Anderson, Sr. Asst. County Attorney, Staff)
 2. A Subdivision Ordinance Text Amendment to Section 18 Pertaining to Exemptions to Hydrogeologic Testing - The Board of Supervisors recently adopted comprehensive amendments to the hydrogeologic testing requirements in the Subdivision Ordinance. Prior to the adoption of those comprehensive revisions, the Board of Supervisors adopted an amended interim Ordinance to exempt family transfer, administrative and large lot divisions from the requirements for hydrogeologic testing. The amendment limited the number of exempt family transfer divisions to "up to two on any property." This amended phrase was inadvertently left out of the comprehensive revisions, when adopted. The proposed amendment will correct that omission. The Board initiated this text amendment on September 13, 2018.  The Planning Commission held a public hearing on September 20, 2018 and voted unanimously to recommend approval. (Christopher T. Butler, Lee District Supervisor, Sponsor; Kimberley P. Fogle, Director of Community Development, Staff)
 3. A Resolution to Approve Special Exception SPEX-18-009524, Mt. Sterling Farm / Sterling Valley - An Application for a Category 26 Special Exception to Waive the Non-Common Open Space Requirement; a Category 29 Special Exception to Waive the Public Street Requirement; and a Waiver of Zoning Ordinance Section 7-450 to Allow a Private Street Longer than 1,320 Feet (PIN 7904-38-9985-000), Cedar Run District - The Applicant is ultimately seeking to subdivide the subject property into three parcels distributed across the parent parcel versus clustering them along Dumfries Road.  In order to accomplish this the Board of Supervisors will need to approve the two Special Exceptions and one waiver. The property is located at 7442 Mt. Sterling Farm Road, Warrenton.  On August 16, 2018 and September 20, 2018, the Fauquier County Planning Commission held public hearings on the Special Exception and Waiver requests and recommended that the application be approved. (Sterling Valley, LLC, Owner/Applicant, Sponsor; Adam Shellenberger, Chief of Planning, Staff)
 4. A Public Hearing to Obtain Citizen Input Concerning an Amendment to the Fauquier County Towing Ordinance, Fauquier County Code Section 13-67 - The Sheriff's Office and Towing Board request and recommend an amendment to Section 13-67(b) of the County's Towing Ordinance to allow the Sheriff's designee to be able to approve and execute towing service agreements. (Christopher T. Butler, Lee District Supervisor, Sponsor; Tracy A. Gallehr, Deputy County Attorney, Staff)
